Question by : I received a “Notice of Determination of Invalid Claim, section 1277″ HOW SHOULD I DO?
I have been unemployed since 04/16/09 and the only income my UI benefits.

My UI been started week 04/12/09 to expired on 04/10/10, My first claim balance was getting on end of November 2009, but new claim continue to automatically then second claim balance was getting on end of March also claim continue to automatically. and then I received last Claim check on first week of April. after this payment claim balance was 4050.00. And then I sent my last claim form on 04/25/10.

On 05/03/10 I received an ADDITIONAL INSTRUCTIONS from EDD CA.

It say,

Please follow the instructions below. “Failure to do so may result in denial of your benefis.” Please include your name and Social Security number on any additional forms you MAIL to the EDD.

1. You are potentially eligible to file a new claim effective 04/11/10. You may apply on-line at WWW.EDD.CA.GOV or call the 1-800-telephone numbers abobe for assistance to complete the filing of your claim.

After 2 weeks I’ve tried to talk to representative call EDD, but NEVER reached it. On 05/17/10 finally I reached representative, I said ” I received an ADDITIONAL INSTRUCTIONS, I want file a new claim.
She said “Why you dont call us long time”, but she helped me file a claim by phone. She asked “Social Security number, Name, Address, Phone number, When you last work day……a line cuts suddenly. I tried to call EDD NEVER REACHED.

Sameday, I found on EDD.CA.GOV.
” You can apply for the federal extended benefits online using the same application that is used for regular unemployment benefits. To apply, click the continue button below and complete the entire application. ”

Finally, I’ve filed new claim on 05/17/10.

And On 05/20/10 I received “NOTICE OF DETERMINATION OF INVALID CLAIM, SECTION 1277″.

It says,

In order tohave a valid claim, section 1277 requires that you were paid or earned at least 00 as an employee in one quarter during the period from 04/12/09 to 04/10/10 and performed some work; or th you were paid or earned at least 0 as an employee inthe quarter of your highest earnings and earned at least 1.25 times your high quarter earnings the above period and performed some work.

My UI benefits been from income based until I lost job (before 04/16/09). then this federal extention is to my expired regular UI. How I could earn 00 or 0 after lost job? I am unemployed only I earn income from my UI benefit.

This is President Obama signed FEDERAL EXTENDED BENEFITS.
Was not Benefits extented up to 99 weeks?
Why State denied this extention?

HOW SHOULD I DO???

Since you are so confused, go over to your local office for unemployment benefits and speak with a counselor about your problem. They can clarify whether or not you are entitled to more benefits.
